U.S. Privacy Policy

Your access to, and use of, the Site is subject to the Terms of Use of Racepoint Global, Inc. (“Racepoint Global” or “we” or “us”). We have created this Privacy Policy to explain what information we gather from you when you visit the Site, how we may use this information, and the security approaches we use to protect your information. This Privacy Policy is incorporated into and made part of Racepoint Global’s Terms of Use, available here. All capitalized terms used but not defined herein have the meanings given to them in our Terms of Use.

By using the Site or any of the Site’s features or services (collectively, the “Services”), you consent to the collection and use of your information by Racepoint Global in accordance with this Privacy Policy. If we decide to change our Privacy Policy, we will post those changes on this page. Policy changes will apply only to information collected after the date of the change.

  1. What information do we collect?
    We may collect information from you when you submit an inquiry or contact us, respond to communication from us such as e-mail, visit the Site or use any of the Services, including, without limitation, as follows:

    • When you submit an inquiry or contact us or when you use any of the Services, we may ask you for Personal Information such as your name, e-mail address, mailing address or phone number, or other information. “Personal Information” is information that can personally identify you. You may, however, visit the Site without providing such information. Providing your Personal Information to us is your choice. If you choose not to provide us with certain Personal Information, you may not be able to take advantage of all of the Services.
    • We use IP addresses and session identifiers to analyze trends, to administer the Site, to track user activities, to infer user interests, and to otherwise induce, deduce, and gather information about individual users and market segments. This information does not identify you personally. We may combine such general information with Personal Information and may use and disclose the combined information in a de-identified aggregated manner, as described in this Privacy Policy.
    • Like many websites, we use “cookies” to enhance your experience and gather information about visitors and visits to the Site. Please refer to the “Do we use ‘cookies’?” section below for information about cookies and how we use them.

    Because there is not yet a common understanding of how to interpret web browser-based “Do Not Track” (“DNT”) signals other than cookies, we do not currently respond to undefined DNT signals to the Site.

  2. How do we use your information?
    We may use the information we collect from you in the following ways:

    • To personalize your Site experience and to allow us to deliver the type of content in which you are most interested.
    • To allow us to better service you in responding to your inquiries and requests.
    • To enforce Racepoint Global’s user policies and other agreements with you.
    • To administer other Site features.
    • To provide you with important administrative information regarding the Site and the Services, such as changes to this Privacy Policy, the Terms of Use or our other policies, and to, more generally, facilitate communication between Racepoint Global and you.
    • To prevent fraud and other prohibited or illegal activities.

    In addition, Racepoint Global may aggregate de-identified data and information collected by Racepoint Global in connection with your use of the Site or the Services with non-identifiable anonymous data from other users and customers to create anonymous aggregated data that does not identify you (“Aggregated Data”). Racepoint Global shall solely own all rights in and to any Aggregated Data, and has the irrevocable right to maintain, store, use, disclose or sell such Aggregated Data. Racepoint Global may use Aggregated Data for its internal purposes, including, without limitation, to perform statistical analyses, and for Racepoint Global’s other business purposes.

  3. Do we disclose the information we collect to outside parties?
    We do not sell, trade, or otherwise transfer to outside parties your Personal Information unless we provide you with advance notice, except as described herein. The term “outside parties” does not include our affiliates and website hosting partners and other parties who assist us in operating the Site, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. In the event that we sell our company, or otherwise transfer any assets of our company relating to the Site, we may provide your information to the purchaser. We may also release your information when we believe release is appropriate to comply with the law, enforce our Site policies, or protect ours or others’ rights, property, or safety. However, information and data that is not Personal Information may be provided to other parties for marketing, advertising, or other uses.
    Racepoint Global does not assume, and expressly disclaims, any liability for third parties that have been provided with information as permitted by this Privacy Policy or who have collected information as permitted by this Privacy Policy.
  4. How can you correct or delete your information?
    We are committed to your Site experience and we respect your privacy. If you tell us that you do not want us to use your Personal Information to contact you, Racepoint Global will respect your wishes. However, you acknowledge that, by opting out of letting us use your Personal Information in accordance with this Privacy Policy, the Site or certain Services, or features thereof, may no longer be available to you. In addition, we are not responsible for removing your Personal Information from the lists or databases of any third party who has previously been provided your information in accordance with this Privacy Policy. If you would like to modify or delete your Personal Information, please send an e-mail to AgencyMarketing@racepointglobal.com with clear instructions about the information that you would like to have modified or deleted. Upon your request, we will remove your Personal Information from our active databases. We will retain in our files the Personal Information you have asked us to remove from our active databases to prevent fraud, resolve disputes, troubleshoot problems, assist with any investigations, enforce our user policies and comply with legal requirements. Therefore, you should not expect that your Personal Information will be completely removed from our databases in response to your requests. However, such Personal Information will only be available to select employees, service providers and governmental persons or entities.
  5. Do we use “cookies”?
    Yes. Cookies are small files that a site or its service provider transfers to your computer’s hard drive through your Web browser (if you allow) that enables the site’s or service provider’s systems to recognize your browser and capture and remember certain information. Cookies are used to help us understand your preferences based on previous or current Site activity, which enables us to provide you with improved services. We may also use cookies to help us compile aggregate data about Site traffic and Site interaction so that we can offer better Site experiences and tools in the future. We may contract with third-party service providers to assist us in better understanding our Site visitors. Google Analytics tracks typical statistical information about you, such as sites you visit and your IP address and browser. Racepoint Global does not collect or store this information; Google does.   6. How do we safeguard your information?
    We follow generally accepted industry security standards to safeguard and help prevent unauthorized access, maintain data security and correctly use your Personal Information. However, no commercial method of information transfer over the Internet or electronic data storage is known to be 100% secure. As a result, we cannot guarantee the absolute security of that information during its transmission or its storage in our systems. You should be aware that Racepoint Global has no control over the security of other sites on the Internet that you might visit or interact with even when a link to any such third party site appears on our Site.
  7. Privacy and Third Party Links
    This Privacy Policy applies solely to information collected by the Site or the Services. In an attempt to provide you with increased value, we may include third party links on the Site. These linked sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of the Site and welcome any feedback about these linked sites (including if a specific link does not work).
  8. Online Policy Only
    This Privacy Policy applies only to information collected through the Site or the Services and not to information collected offline or content, business information, ideas, concepts or inventions that you send to Racepoint Global as part of a prospective or ongoing business relationship. Disclosure of such other information may be governed by a separate agreement between you and Racepoint Global.
  9. Important Notices to Non-United States Residents
    It is important to note that the Site is operated in the United States. If you are located outside of the United States, please be aware that any visitor information you provide to us will be transferred to the United States. By using the Site and/or providing us with your visitor information, you consent to this transfer.
  10. Children’s Privacy
    We do not target or intend to collect Personal Information from children under 13 years of age. Racepoint Global will never knowingly request or collect Personal Information online from minors without prior verifiable parental consent. To use the Site or any Service, you must be the age of legal majority in your place of residence. By using the Site or any of the Services, you hereby represent that you are at least the age of legal majority in your place of residence or have otherwise provided us with parental consent. All information provided to Racepoint Global will be treated as if provided by an adult. If a child has provided us with Personal Information, a parent or guardian of that child may send an e-mail to AgencyMarketing@racepointglobal.com with “Request for Child Information Removal” on the subject line and the name and age of the child in the body of the message. Upon verification, we will delete the child’s information from the applicable databases that store information for the Site.
  11. California Residents
    If you are a resident of California, in addition to the rights set forth in this Privacy Policy, you have the right to request information from us regarding any disclosure of Personal Information to third parties for their direct marketing purposes under California’s “Shine the Light” law. If you wish to make such a request, please send an e-mail to AgencyMarketing@racepointglobal.com with “Request for California Privacy Information” on the subject line and your name in the body of the message. In response, we will e-mail you the required details regarding the information we shared with such third parties during the prior calendar year.
